Have you ever considered how your dad will afford his medical care over the next years and decades? When he’s on a limited income and his health is worsening, he may reach a point where Medicare isn’t enough, especially if he needs nursing home care. Medi-Cal is both a California and federal government program designed to help older adults afford important healthcare services. As it’s an income-based program, there are limits on when your dad will qualify. Here’s what your family needs to know about Medi-Cal planning and why it’s important to work with an elder law attorney.

What Are the Requirements?

Once your dad turns 65, Medi-Cal is available if his income is no more than $1,040.21 per month (SSI benefits) or $1,584 per month (Share of Cost or Aged & Disabled Federal Poverty Level). His assets cannot exceed $130,000, not counting his main home or car. If he’s trying to qualify for SSI, his assets cannot exceed $2,000.

Your dad’s main home and car do not count as assets, but there are other items that also don’t count. Prepaid burial plans and plots (up to $1,500), life insurance with a face value of $1,500, and household/personal items do not count.

Rules regarding long-term care in a nursing home are different from the rules for an older adult who will remain at home. This is one reason why it helps to work with a Medi-Cal elder law attorney.

Medi-Cal Helps With Long-Term Care in a Nursing Home

As adults live longer lives, it’s likely that your dad’s chronic health condition will lead to financial strain. He may find it hard to pay for the medical treatments and medications he needs. Worse, he may have an illness like Alzheimer’s disease that drains his savings as his need for around-the-clock care with skilled nurses increases.

If he qualifies for Medi-Cal, he may need to change doctors. This is an important consideration and not every doctor or dentist accepts Medicaid. If this will cause distress, you’ll need to have a plan in place to help support him through the change. When he has Alzheimer’s or dementia, little changes like this can be extremely stressful for him.

Medi-Cal helps with some aspects of long-term care, but only if his income and assets are low enough to qualify. He can’t quickly spend down his assets or give them away in order to qualify faster. If he does that, he can be penalized and lose the chance to qualify for months or years. That’s why he should work with a Medi-Cal attorney.
